Warm 106.9 2013 Christmas Lights Photo Contest Official Rules

WARM 106.9 CHRISTMAS LIGHTS PHOTO CONTEST OFFICIAL CONTEST RULES
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED.
“WARM 106.9 CHRISTMAS LIGHTS PHOTO CONTEST” contest (the “Contest”) will begin at approximately 12:00 AM PT (Pacific Time) on November 18, 2013 and end at approximately 10:59 AM PT on December 12, 2013.
By submitting, voting or participating at any level you are agreeing to be bound by these contest rules.
How to Enter the Contest:
a. Submissions for the Contest will begin at approximately 12:00 AM Pacific Time (PT) on November 18, 2013 and end at approximately 10:59 AM PT on December 12, 2013.
b. To secure your submitted entry in the Contest you must enter via the following method.
i. Online: Beginning at approximately 12:00 AM PT on November 18, 2013 go to www.warm1069.com, click on the contest entry link, and complete an official entry form including your First Name and Last Initial, Date of Birth, and address including zip code. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization responsible for assigning email addresses or the domain associated with the submitted email address. For purposes of these official rules, receipt of an online submission will be solely determined when the www.warm1069.com web server records the submission information. Any automated computer receipt (such as one confirming delivery of email) does not constitute actual receipt of a submission form for purposes of these official rules. Warm 106.9/KRWM's computer is the official time keeping device for this Contest.
All submitted entries must be received by 10:59 AM PT on December 12, 2013
a. Additional entry options may be made available at the sole discretion of Warm 106.9/KRWM (the “Contest Entities”).
b. Limit one (1) entry per person. Limit one (1) entry per property address.
c. All submissions become the sole property of the Contest Entities and will not be returned.
d. The Contest Entities are not responsible for lost, stolen, damaged, miss-delivered, mangled, incomplete or late entries or for entries not received due to difficulty accessing the Internet, service outages or delays, computer difficulties or other technological glitches.
e. Each submission must not contain copyrighted materials or any other materials that may be restricted, prohibited or outlawed by federal, state or local laws.
f. The Contest Entities in their sole discretion, reserve the right to disqualify any submission if such submission contains illegal, indecent or otherwise offensive material, submissions that are not authorized by the candidate or if such act contains material whose content is deemed, at the sole discretion of the Contest Entities to be unsuitable for the public or broadcast on Warm 106.9/KRWM (i.e. pictures must be clean and no nudity).
g. Photo submissions must be photo of submitter's own residence and may not include more than one image per person (no collages). No text or logos will be permitted. Photos must fit the theme of this contest.
h. Any entries whose submission does not comply with these rules will be disqualified.
Eligibility Restrictions:
a. The contest is open to candidates who are a minimum of 18 years of age or older as of November 18, 2013 residing in the State of Washington. 
b. Submitters must login create an account with UPICKEM on www.warm1069.com.
c. Subject to state laws, Warm 106.9/KRWM contests are open to legal residents of Washington State except for employees and their families of Hubbard Radio Seattle LLC, their affiliates and their dependents and employees of media outlets in the Seattle Market area. Unless otherwise noted, all entrants must reside within the TSA boundaries applicable to Warm 106.9/KRWM as defined by Arbitron. Employees of any participating contest sponsor, their affiliates and their dependents are not eligible to enter/win. Subject to all applicable federal, state and local laws and regulations. 
d. Warm 106.9/KRWM permits one (1) "prize of value" winner per household per 30 days. This includes all contest features, major contests, consolation prizes, special listener events, weekend giveaways, ticket windows, online contesting, random drawings and all other contesting on Warm 106.9/KRWM. This does NOT apply to movie premiere events (winning tickets to a Warm 106.9/KRWM movie premiere will not count as a "prize of value" included in the 30-day waiting period).
e. In the event a listener wins a "prize of value" and they (or someone in their household/family) wins another "prize of value" within the 30 days of winning the original prize, the 2nd prize will be forfeited, regardless of prize and/or value.
f. Contestants are required to provide truthful information and the Contest Entities will reject and delete any entry it discovers to be false or fraudulent. The Contest Entities will disqualify any entry from individuals who do not meet the eligibility requirements.
Prizes:
a.  One Grand Prize will be awarded: $750.00 in cash, check or Visa gift card.
i. One second place prize will be awarded: $500 in cash, check or Visa gift card.
ii. One third place prize will be awarded: $250 in cash, check or Visa gift card.
b. All prizes will be mailed to winner. Winner will be required to submit a winner release form and W-9 for prize at Hubbard Radio Seattle LLC, 3650 131st Ave SE Ste. 550, Bellevue WA 98006. Winner must also provide proof of residency at winning address at that time. Winner will have 30-days to do so.
c. Prizes will be mailed with the prior written consent of the winner and therefore, winner assumes the risk of its loss. The Contest Entities are not responsible for the safe arrival of a prize or prize certificate delivered in this manner.
d. There is no substitution, transfer, or cash equivalent for prizes, except that Contest Entities may, at their sole discretion, substitute prizes of comparable value or cash. Prizes are expressly limited to the item(s) listed as described above and do not include taxes, gratuities or any other expenses. Other restrictions may apply.
Selection of Winners:
a. Decisions of the Contest Entities with respect to the contest are final.
b. Each entrant meeting all eligibility and submission requirements of these official rules will be posted on www.warm1069.com where listeners can view the entries.
c. Only one registered account per voter. If multiple accounts are detected for a single voter, they will be disabled and votes disqualified.
d. When voting is open, listeners may vote up to ten times per day.  Listeners may use their ten votes any way they see fit (i.e.: using all ten votes on one candidate or using all ten votes on multiple candidates.)
e. The Contest Entities (including UPICKEM) are not responsible for votes not received due to difficulty accessing the internet, service outages or delays, sabotage, viruses, network connection, satellite failures, phone line failures, electrical outages, computer difficulties or other technological glitches, natural disasters or acts of man or God.
f. The Voting Schedule will be as follows:
Voting Period 1
- All eligible entrees received will be placed in voting round one. Photos will be reviewed to make sure they meet requirements of submission and then added to voting round one. Warm 106.9/KRWM reserves the right to refuse any entry.
- Between 12:00 AM PT December 13, 2013 and 11:59pm PT December 18, 2013 any listener registered to vote can go online to www.warm1069.com and vote for their favorite candidate(s).
- The one (1) candidate that receives the most votes during this voting period will be selected as the 1st Place Winner of WARM 106.9 CHRISTMAS LIGHTS PHOTO CONTEST (subject to verification of eligibility).
- The one (1) candidate that receives the 2nd most votes during this voting period will be selected as the 2nd Place Winner of WARM 106.9 CHRISTMAS LIGHTS PHOTO CONTEST (subject to verification of eligibility).
- The one (1) candidate that receives the 3rd most votes during this voting period will be selected as the 3rd Place Winner of WARM 106.9 CHRISTMAS LIGHTS PHOTO CONTEST (subject to verification of eligibility).
- In the event that there is a tie for 1st, 2nd, or 3rd position, then the station entities will select the candidate to continue on. If a candidate is ineligible, the prize will go to eligible candidate with the next highest number of votes (IE: If first place candidate is deamed ineligible then the second place candidate will become the first place candidate and third place candidate will move to second place and so on).
g. On Friday, December 20, 2013 at TIME TBA - the winners of WARM CHRISTMAS LIGHTS PHOTO CONTEST will be announced on-air and/or posted on warm1069.com.
h. Winners need not listen nor be present to win.
i. The winners will also be contacted by the Contest Entities via telephone no later than December 23, 2013.
j. Odds of winning will be determined by the number of eligible votes and entries received.
k. Winners must execute and return any required Affidavit of Eligibility and/or Release of Liability Prize Acceptance Form within thirty (30) days of notification attempt or prize will be forfeited and an alternate winner will not be chosen.
l. Winners will receive a winner’s release form from Warm 106.9/KRWM and are subject to the conditions outlined on the acknowledgement forms. If a winner is deemed ineligible, he or she will be contacted by telephone.  The information provided by the winner will be kept in confidence by Warm 106.9/KRWM and will not be disclosed to any third party excluding the IRS if prize accumulation exceeds $600 in a calendar year or in the event of a Hubbard Radio Seattle LLC audit.
m. By accepting the prize, the winner releases the Contest Entities and all sponsors/participants from any/all physical liabilities resulting in injury or death. Each winner, by acceptance of the prize, agrees to release all Sponsors, and their parent and subsidiary companies, their officers, directors, employees, agents, shareholders, affiliates, suppliers, distributors, and advertising agencies from all liability, claims, or actions of any kind whatsoever for injuries, damages, or losses to persons and property which may be sustained in connection with the receipt, ownership, or use of the prize.
n. Winner certifies he/she has read, understands and will abide by all contest rules.
o. Winners must meet all eligibility requirements.
p. Winner will look solely to the manufacture and/or the end supplier for goods and services for all warranty and liability claims.
Conditions:
a. Payments of all federal, state and local taxes are solely the responsibility of the winner(s). Winners will be required to complete and submit an IRS Form W-9 with the winner’s full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by the Contest Entities in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize.
b. By participating in the contest, the winner or winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this contest without additional financial or other compensation, and where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.
c. Prior to awarding any prize or prize certificate the Contest Entities in their sole discretion may require contest winners to sign a liability release, agreeing to hold the Contest Entities, their corporate licensee, parent, subsidiary and affiliated corporations and the officers, shareholders, directors, employees, agents and representatives, advertising agencies, participating sponsors and promotional partners to all be held harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the contest.
d. The Contest Entities, in their sole discretion, reserve the right to disqualify any person tampering with the entry process; the operation of Warm 106.9/KRWM’s Web Site or is otherwise in violation of the rules. It further reserves the right to cancel, terminate or modify the Contest if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.
e. The Contest Entities reserve the right to make changes in the rules of the contest, including the substitution of a prize or prizes of equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Contest Entities, any competition or prize-related event is delayed, rescheduled, postponed or cancelled, the Contest Entities reserve the right, but not the obligation, to cancel or modify the Contest and shall not be required to award a substitute prize.
f. Failure to comply with the contest rules may result in a contestant’s disqualification, at the sole discretion of Contest Entities.
g. The Contest Entities are not responsible for typographical or other errors in the printing, the offering or the administration of the contest or in the announcement of a prize.
